David Winfrey concentrates his practice in the areas of complex regulatory and transactional matters and has developed expertise in the areas of environmental, health and safety, and transportation (EPA, OSHA, DOT). Mr. Winfrey's particular focus is on the oil and gas, waste management and trucking industries. He has a diverse state and federal practice handling regulatory issues involving hazardous and solid waste treatment, storage, transportation and disposal, Comprehensive Environmental Response Compensation and Liability Act (CERCLA) and state Superfund-type cleanups, site remediation, EPCRA/SARA Title III, and OSHA, as well as issues arising under the Federal Clean Air Act, the Clean Water Act, and their state counterparts.
Mr. Winfrey has experience defending enforcement actions brought under all major federal environmental statutes and implementing regulations before federal and state agencies, challenging liability and negotiating allocations of potential liability for cleanup of contaminated sites, responding to governmental, private party and community complaints that could impact a client's reputation, and evaluating pending transactions for potential legal exposure and adverse impacts on client interests. He also has significant experience developing and implementing compliance assurance programs and best management practices. Such involvement includes compliance auditing, management and front-line employee training, as well as execution of privileged root cause and latent cause analysis investigations following catastrophic or high-profile events.
Mr. Winfrey is admitted to practice in the states of Texas, Oklahoma, and Missouri (inactive) and is a member of the Natural Resources, Energy, and Environmental Law Section of the American Bar Association, the Environmental Law Section of the Oklahoma Bar Association, the Environmental Law Section of the State Bar of Texas, and the American Society of Safety Engineers. He is a member of the Environmental Law Institute's distinguished Environmental Law Advisory Panel. Additionally, he has been a panelist and speaker at national environmental law seminars and conferences such as the ABA's Annual Environmental Law Conference in Bethesda, Maryland, the National Transportation Lawyers national conference, and the ABA Labor and Employment OSHA Subcommittee annual conference.
Mr. Winfrey earned a Bachelor of Sciences degree in Political Sciences from Oklahoma State University in 1985, where he served as Chief Justice of the Student Government Association Supreme Court. He received his J.D. in 1988 from the University of Tulsa, and while in law school, he served as a staff member on the Tulsa Law Journal from 1986-1988. He obtained an L.L.M. in environmental law from Northwestern School of Law, Lewis & Clark College, in 1992.
Mr. Winfrey's community service includes prior service on the board of Leadership Tulsa, Tulsa Authority for the Recovery of Energy (TARE), and the Indian Nation's Council of Governments (INCOG) Clean Air Committee. |
